1. Who we are

berimi (the "Service") is operated by Mattew Thao, an independent business (sole trader / micro-entreprise registered in France) trading as berimi.

By using berimi you agree to these Terms. If you do not agree, please do not use the Service.

2. The service

berimi turns a photo you upload into stylized AI avatars. You buy credits and spend them to generate avatars (1 credit = 1 avatar). New styles are added regularly. The Service is provided online and may evolve over time.

3. Eligibility

You must be at least 15 years oldto use berimi. By creating an account or signing in, you confirm that you are 15 or older and legally able to enter into these Terms. If you are under the age of majority in your country, you confirm that you have your parent's or guardian's permission.

4. Your account

You need an account to keep your credits and avatars in one place. You are responsible for keeping your login secure and for activity on your account. Sign-in is handled through Google or email. Let us know at berimi.app@gmail.com if you think your account has been compromised.

5. Credits, pricing & payment

• 1 credit = 1 generated HD avatar (1024×1024).
• Credit packs: Lite $8.99 (3 credits) · Plus $14.99 (8 credits) · Pro $24.99 (18 credits).
• One-time purchases only — no subscription and credits never expire.
• Prices are shown in US dollars before purchase. Any applicable taxes (such as VAT or local sales tax) are calculated and shown at checkout by our payment provider.
• We may change prices or pack contents for future purchases; changes never affect credits you have already bought.
• Payment is processed by our third-party payment provider, which may act as the merchant/reseller of record and handle applicable taxes. We never see or store your full card details. Accepted methods include card, Apple Pay and Google Pay.

6. The avatar guarantee

Every avatar is guaranteed. If a generation comes out bad or buggy, report it from the app (or email us) and we'll review it — if confirmed, we credit 1 credit back to your account (typically within 12h), so no credit is wasted. This guarantee covers technical failures and clearly broken results, not simple dissatisfaction with an artistic style.

7. Refunds & right of withdrawal

Avatars are digital content delivered instantly. By starting a generation, you ask us to begin immediately and you acknowledge that you lose your 14-day right of withdrawal for the credits used.

Unused credits can be refunded within 14 days of purchase on request at berimi.app@gmail.com. This is without prejudice to any mandatory refund rights you have under the consumer law of your country of residence.

8. Your content & acceptable use

By uploading a photo, you confirm that:

• the photo is of you, or you have the right and consent to use it;
• you will not upload illegal, hateful, violent, sexual, harassing or infringing content, or images of minors in any inappropriate context;
• you will not use berimi to impersonate, deceive or harm anyone;
• you will not attempt to disrupt, reverse-engineer, scrape or abuse the Service or its rate limits.

We may remove content and suspend or close accounts that break these rules. Our style names (e.g. "Cartoon 2D") are generic descriptions and are not affiliated with, endorsed by, or connected to any brand, studio or franchise.

9. AI-generated results

berimi uses automated AI models. Results vary and we cannot guarantee a specific outcome, an exact likeness, or that an avatar is free of artefacts. AI output may occasionally be unexpected. You are responsible for how you use your avatars and for checking they are suitable before sharing them.

10. Your photos & privacy

Your uploaded photo is deleted after generation (within 24h) and is never used to train any AI model. The avatars you generate stay in your account until you delete them. Full details are in our Privacy Policy.

11. Intellectual property

You own the avatars you generate and can use them as you like, including on social media. The berimi name, logo, website, design and code remain ours — you may not copy, resell or redistribute them, or use our brand without permission.

12. Availability & changes to the service

berimi is provided on an "as available" basis and is actively being improved. We may add, change, suspend or discontinue features at any time. We try to keep the Service running smoothly but cannot promise it will always be uninterrupted or error-free.

13. Suspension & termination

You can stop using berimi and delete your account at any time. We may suspend or close an account that breaches these Terms or that we reasonably believe is being used unlawfully. If we close your account without cause, we will refund any unused credits.

14. Liability

berimi is provided "as is". To the fullest extent permitted by law, we are not liable for indirect or unforeseeable losses, and our total liability is limited to the amount you paid us in the 3 months before the claim. Nothing in these Terms limits any rights you have that cannot be limited by law, including mandatory consumer protections in your country.

15. Changes to these terms

We may update these Terms; we'll change the date above and, for significant changes, let you know in the app or by email. Continuing to use berimi after a change means you accept the updated Terms.

16. Governing law & disputes

These Terms are governed by French law. If you are a consumer, you keep the mandatory legal protections of your country of residence, and you may bring proceedings in your local courts. EU consumers can also use the EU Online Dispute Resolution platform. Before any dispute, please contact us first — we want to make it right.
